TERMS AND CONDITIONS

1.- YOUR CONTRACT

“The South of Spain” is a trading name of María Elena Toscano Jaén, with NIF 44954114Q. Subject to the law, these are the conditions of the contract between you (“you”) and María Elena Toscano Jaén (hereinafter “The South of Spain”), with its registered address at Calzada de la Infanta, 8, Sanlúcar de Barrameda, CP 11540, Cádiz, Spain.

As soon as you book and make a deposit or full payment for a package, a contract is formed.

2.- INSURANCE COVER

It is a condition of your contract with us that you must take out suitable travel insurance cover, which should ensure that you are sufficiently covered against any unforeseen cancellation costs or costs that may arise whilst on holiday. This may include loss of personal effects or money as well as personal liability claims.

It is your responsibility to read and understand the insurance policy and ensure that it is suitable and adequate for your particular needs. Please read your policy details carefully and take them with you on holiday.

If you choose to travel without adequate insurance cover, we can't accept you in our packages. 

3.- AMENDMENTS AND CHANGES

If you want to amend any element of your booking, we will strive to assist as much as possible, but we do not guarantee any desired changes to your itinerary. 
If it is possible, no administration charges will be made for ONE change to the dates of the itinerary before the balance due date, with only any non-refundable elements or cancellation fees by the relevant suppliers to pay.

Once your balance is paid, the following administration charges will also be made:

More than 14 days before departure date – 25€ per person
Less than 14 days before departure date - up to 100% of the full amount paid.

4.- CANCELLATIONS

Packages are subject to the following cancellation charges:

- 90 days or earlier before departure – loss of deposit, or 20% of total package price, whichever is greater
- From 89 to 60 days before departure – 50% of total package price
- From 59 to 31 days before departure – 75% of total package price
- 30 days or less before departure – 100% of total package price

Depending on the reason for your cancellation, you may be able to reclaim these cancellation charges (less any applicable excess) under the terms of your own travel insurance policy. Claims must be made directly to the insurance company concerned.

5.- CHANGES MADE BY US

It is highly improbable that we will need to make any modifications, however on occasions it may be necessary to switch your accommodation to an alternative in the same category or amend the time of a tour due to circumstances outside our control. We will make you aware at the earliest possible time about this type of change, however we are not able to pay compensation.

If we have to effect what we consider to be a significant amendment to your itinerary, we will let you know straight away and offer you the choice of a full refund or a different package.

If you opt to proceed with the amended booking, you will be eligible for compensation of up to 20€ per person, excluding infants.

6.- FORCE MAJEUR

We cannot give any compensation or refund of any nature whatsoever for amendments and cancellations arising out of circumstances beyond our control which could not have been avoided, even if all reasonable measures were taken.

These circumstances include threat of war, war, civil strife, riot, terrorism, industrial action – strikes (including, but not limited to, strikes and official or unofficial industrial action by train operators, train operating companies, track operators or otherwise), industrial disruption, adverse weather conditions, natural disaster, government action, fire or other events outside our control.

7.- COMPLAINTS

If you are dissatisfied with the standard of accommodation or any services provided by us, you should inform us immediately to our WA number or this email address: [email protected].
We will try to do our best to satisfy your demands. 
If you have any written complaints, these must be made to us within 4 weeks of your return from the holiday.

8.- CONDITIONS

The contract between you and The south of Spain is based on the booking conditions outlined here and all supplementary information found on our website, which are under the jurisdiction of the laws of Spain.

9.- PASSPORT, VISA AND ENTRY REQUIREMENTS

You are responsible for ensuring that you hold a valid passport and visa if appropriate. Visa requirements may vary for holders of different passports. We cannot accept liability for any loss you may suffer as a result of not being in possession of the correct travel documents.
It is also your own responsibility to ensure you meet all entry requirements for the destinations on your holiday. Our staff may be able to give general advice to aid your trip planning. However, regulations are constantly changing and we strongly advise you to check with the relevant embassy or consulate for up-to-date visa information and entry requirements.

10.- SPECIAL REQUESTS

You must advise us in writing at the time of booking, of any special requests you may have. Whilst we will endeavour to communicate reasonable requests to the appropriate supplier, we regret we are unable to guarantee any such request will be fulfilled, except in cases where we have, in writing, specifically confirmed this.

Confirmation from us that a request has been noted and communicated to the supplier, or the mention of the special request on any documentation is not confirmation that the request will be fulfilled. All special requests are subject to availability, unless and until specifically confirmed in writing.

Unfortunately we cannot accept conditional reservations, that is, any booking that is identified to be conditional on the fulfilment of a particular special request. Bookings of this nature will be considered “standard” bookings and will be subject to the above details on special requests.

11.- PRE-EXISTING MEDICAL CONDITIONS, MOBILITY AND DISABILITY REQUIREMENTS AND YOUR ABILITY TO PARTICIPATE

The nature of this trip means that in some cases it may be unsuitable for those who use a wheelchair or have reduced mobility. However, we will be delighted to discuss the feasibility of creating a tailor-made itinerary for you that takes into consideration your level of mobility.
It is essential that you advise us before booking if you do have any disability or pre-existing medical condition which may affect your holiday, or if you have any special requirements as a result of any disability or medical condition (including any which affect the booking process) so that we can assist you in considering the suitability of the arrangements and/or in making the booking. It will also enable us to make sure you receive the relevant level of assistance when you fly.

Full details must be confirmed in writing at the time of booking and whenever any change in the condition or disability occurs. On our tailor-made tours and escorted group tours the guides and tour leaders are, unfortunately, unable to offer additional assistance to passengers with limited mobility and all such assistance will need to be provided by whoever the passenger is travelling with. We may request that you provide a letter from your doctor confirming your fitness to travel.

12.- PRICES

Prices are in Euros and include local VAT (IVA)
Prices are subject to changes depending on the season. You will be informed about the total price once we have estimated the total budget of your travel, before making the payment. Please note, the information and prices shown on our website and/or our quotations may have changed by the time you come to book your holiday.
Whilst every effort is made to ensure the accuracy of the website, quotations and prices at the time of publication or when they are given to you, regrettably errors do occasionally occur.
You must therefore ensure you check all details of your chosen holiday (including the price) with us at the time of booking.

13.- YOUR CONDUCT

You undertake to behave with propriety and in such a manner as not to cause or be likely to cause material distress, danger or upset to any other client(s) and/or any third party or damage to property.

If we, our employees, agents or suppliers consider you are not behaving accordingly, we reserve the right to terminate your contract and neither we nor the providers of any of the services in question will have any further contractual obligations to you either in respect of covering any expenses, paying any compensation or refunds, or arranging for your return home.

When you book with us, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid direct at the time to the accommodation owner or manager or other supplier. If the actual cost of the loss or damage exceeds the amount paid where estimated, you must pay the difference once known. If the actual cost is less than the amount paid, the difference will be refunded.

If you fail to do so, you will be responsible for meeting any claims subsequently made against us (together with our own and the other party's full legal costs) as a result of your actions.

14.- ASSISTENCE DURING YOUR TRIP

In the event you end up in difficulty (of any sort) during your holiday, we will provide you with appropriate assistance as soon as reasonably possible including by the provision of appropriate information on health services, local authorities and consular assistance and by assisting you to make distance communications and to find alternative travel arrangements as may be applicable.

Where you are in difficulty as a result of your negligence, we may charge you a reasonable fee for this assistance, which will not exceed the costs we actually incur.

15.- BOOKING PROCESS AND PAYMENTS

To secure your booking we require a deposit of 30% of the total holiday cost per person. If you are booking within 90 days of departure, then full payment is required. On receipt of your correct deposit, we will book your arrangements and issue a confirmation invoice. The total balance is due 90 days before departure. If it is not paid in time, we reserve the right to cancel your travel arrangements and retain your deposit.

A contract will come into existence on the date on which we issue a confirmation invoice. When you make a booking you are confirming that you are at least 18 years of age and that you understand our booking conditions and have accepted them on behalf of yourself and all members of your party. All contracts with us are subject to these booking conditions.

Payment can be made by bank transfer or by most major credit cards in favor of The south of Spain. If for any reason we do not accept your booking, your deposit will be returned. No credit cards fees are applied. All wire transfer costs are borne by the customer.
